CONCERNING OFFER TO SELL 3 73 ACRES IN THE
CITY'S BUSINESS/INDUSTRIAL PARK
WHEREAS, the City of Muskego has received from Kr John A
Hourihan as Offer to Sell for 3 73 acres of land he purchased
from the City of Muskego in October, 1977, and
WHEREAS, the Offer to Sell amounts to $64,542 73, and
WHEREAS, Mr Hourihan purchased the property for $34,000 00,
and
WHEREAS, in accordance with the Rules and Regulations for the
Muskego Business/Industrial Park, As Amended, it provides that
the sale of land by the city is made with the understanding
that the purchaser will construct a building with no less
of the property by the city to the purchaser and further'
than 2500 sq feet within twelve (12) months of the conveyance
provides that in the event any purchaser of land from the
city elects to sell any portion thereof, under certain terms
and conditions, an offer to the city must be made, in writing,
to sell the land back to the city under certain terms and
conditions, and
WHEREAS, the agreement further provides that the city has
90 days to accept or reject the offer and in the event it
is accepted they shall pay to the seller the original cost
of the land plus certain interest and cost of certain
improvements and special assessments, and
WHEREAS, the Finance Committee has recommended rejection of
of that allowed under the rules and regulations of the Muskego
the Offer to Sell because said offer is for a price in excess
Business/Industrial Park
THEREFORE BE IT RESOLVED the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does
hereby reject the Offer to Sell submitted by Mr John F
Hourihan for Lots 3, 4 and 5, Block 5 (3 73 acres) to the
city for $64,542 73 because the price is in excess of that
allowed under the rules and regulations of the Muskego Business/
Industrial Park
BE IT FURTHER RESOLVED that the city demands that John F
Hourihan submit an offer in conformity with the rules and reg-
ulations of the Muskego Business/Industrial Park and it is to
be expressly understood that John F Hourihan is not released
from such a requirement as to the property stated above
BE IT FURTHER RESOLVED that a certified copy of this resolution
and t'he Offer to Sell, including the legal description, be
recorded with the Waukesha County Register of Deeds by the City
Clerk forthwith
