APPROVAL OF AGRE.E\IENT ,AND FEES FOR INSPECTION
AND ZOYINC SERVICES FOR THE VILLAGE OF 13IC BEND
WHEREAS, the Trustees of the Village of Big Bend have requested
that the Common Council of the City of iluskego consider entering
spectiun Department and Zoning Office would provide limited
into an agreement whereby the Cjty of Muskego's I3uilding In-
services for the village, and
WHEREAS, the Finance Committee has recommended the Common
Council approve the request and that a fee of $20 00 per
hour be established,
THEREFORE, DE IT RESOLVED that the Common Council of the City
of hluskego, upon the recommendation of the Finance Committee,
does hereby authorize the Mayor and Clerk to execute an
agreement prepared by the City Attorney whereby the City of
Muskego would provide inspection and zoning services to the
Village of Big Bend at a cost of $20.00 per hour.

2. Preamble
A. State Statute subchapter I, I1 and I11 of Chapter 101
authorized the Department of Industry. Labor and Human Relations
. to promulgate standards for the construction of one- and tuo-
fuily chmllings, including manufactured dwellings, and to in-
sur. conformance to such st8ndards by the adoption of inspection
procedures. Such requlationa were published in the Wiscon8in
R0gist.r (December 1979) with an effectiva date of June 1, 1980.
8. Pursuant to the provisions of 101.65 and 101.76, munici-
palitiea may exercise jurisdiction over the construction and in-
sp.ction of new dwellings by passage of ordinances meeting the
roquirmnta of the one- and --family dwelling code. That the
Villaga of Big Bend h8s p8ss.d 8n ordinance approved by the
Uisconain Department of.Industry, Labor and Human Relations a1-
1wing the Village of Big Bend to contract with the City of
Muskego for the services set forth in this agreement.

In furtherance of the above intentions and intending to be
mutually bound the parties hereto agree as follavs:

The Village of Big Bend shall carry out the administration
and enforcement of the Uniform Dwelling Code and assist the
City of nuskego in any legal aspects of enforcement, such as
hiring expert witnesses, etc. TO perform its obligations under
this contract, the City of Muskego agrees to conduct such plan
examinations and inspections using the services of inspectors
certified in the diaciplinem for which such inspection8 are
conducted. The City of uuakego further agrees that such certi-
fied personnel will conduct all necessary and reouired inspec-
tions on one- and two-family dvellings constructed in the Village
of Big Bend located in Waukesha County.

It is further agreed that the City of Muskego will make
- available upon rmest by the Big Bend inspection reports on all a
inspections conducted.
City of Muskego shall provide additional information as may
reasonably be required by Big Bend. Such information may in-
clude, but is not limited to, certification, representations,
statements and financial and technical reDorts and data.
4. Scope of the HDrk
To perform ita obligations under thia contract. the City of
nuskego agrees to perform the following job functions in a man-
ner consistent with the provisions of Chapter Ind. 20 through 25
of the Uniform Dwelling Code.
To perform inspections in the following areas per the ad- a
ministrative procedures described in Ind. 20.10 of the Uniform
Dwelling Code.

5. Office Procedures of the City of nuskcso
(1) Maintenance of records. including inspection and
financial records.
(2) The City of nusksgo shall establish and maintain ado-
quato rocordm of e11 exponditures incurred under the contract.
All records rust be kept in accordance vith generally accepted
accounting procedures. All procedures must be in accordance
vith federal, state and local ordinances.

7. Pemit Fees
The Village of Big Bend has established permit fees by
ordinance.

above at the below ratos. The bela compensation shall include
actual travel and per diem expenses incurred so that no addi-
tional compensations shall be due the contractor €or such eqon-
ses : $20 00 Per Hr.

9. Period of Performance

10. hlrin8tiOn of Contract
Either party may terminate thin contract at will upon thirty
(30) dayn prior written notice to the other party.
11. Liability
That it i8 hereby agreod that the Village of Big Bend will
hold harmlem and/or indemnify the City of Muskcgo and/or any
.1playoo8, officorm or wont8 of tho City of Munkqo and pmvido
defense €or any claim brought againmt the City of Mu8k.go and/or
mqainnt any employee, officor or agent of the City of Muskego
vho is performing a function pursuant to this aqreemcnt.
