CCR1980185RESOLUTION #lS5-80 + ACKNOWLEDGING RECEIPT OF WAIVER OF HEARING AND LEVYING SPECIAL ASSESSMENT ON PROPERTIES IN ASSESSMENT DISTRICT M (Twelve Properties on N. Shore Dr.) . !JHEREAS, the City of Muskego--has received a Waiver of Special Assessment Notice and Hearings from several landowners on North Shore Drive in which they consent to the levying of special assessment against said properties under Sec. 66.60, Wisconsin Statutes, for the cost of improvements, and WHEREAS, the request made by the owners provides for the con- struction of a lateral from an existing sewer main to the real estate described as follows: a Donald H. (3) Said assessment may be paid in ten annual equal installments, the first installment being due on the 1st day of November, 1981, and subsequent installments annually thereafter. Interest at the rate nine (9%) per cent per annum on the entire assessment shall be cha The first installment due shall include interest on the entire asses- sment from the date hereof to the 31st day of December, 1981. Subsequent installments shall include one year's interest upon the unpaid balance of the assessment. (4) The City Clerk is directed to give notice of this assessment by mailing a copy of this resolution to the owners of the above listed properties at their last known post office address or by personal service upon the owner. '(5) If the owner of the property shall file with the City Clerk within thirty days from the mailing or service of the aforesaid notice, a written notice that they elect to pay the special assessment payable in installments shall not be made against said property o upon their property on or before November 1, 1981, special assess such owners, and the owners shall pay the entire assessment when due. (6) In the event a person so elects to pay such assessment on or before November 1-;-1981, but fails to do so, the entire amount of- such December 31, 1981, at the rate of nine (9%) per cent per annum, which assessment together with interest thereon from date hereof to shall be entered on the tax roll for the year 1981 and collected as are other taxes of the city, on a ten year installment basis. (7) After the time for making such election shall have expired, such assessment shall be due and payable in installments as aforesaid, but any assessment may be paid in full before due only upon the payment of interest to date of prepayment upon. such assessment plus one year's interest on the then unpaid principal amount of such assessment.
