ESTABLISHING POLICY REGARDING LITIGATION
OVER POLLUTION OF LAKES WITHIN THE CITY
WHEREAS, concern has been expressed by residents living
Bay Protection and Rehabilitation Districts over the
in the Little Muskego Lake and Big Muskego.Lake - Bass
possibility of being sued for acts or conditions which
are beyond their control, and
WHEREAS, they are particularly concerned over the possibility
of litigation regarding downstream pollution, and
WHEREAS, the Common Council wishes to assure them that the
city would act in their behalf, if at all possible, in the
event litigation were started against the districts be-
cause of downstream pollution,
THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby adopt a policy whereby in the
event either Little Muskego Lake or Big Nuskego Lake -
Bass Bay Protection and Rehabilitation District become
involved in litigation for-polluting their .outlet streams
the City of Muskego does hereby declare its intent to aid
the districts in that litigation to the extent permitted
by law..
