RESOLUTION CLARIFYING THE CITY'S POSITION
REGARDING THE FORMER LASSA LOT
WHEREAS, on the 9th day of October, 1979, Resolution 8195-79,
entitled, Acceptance of Offer to Purchase a Portion of Former
Lassa Lot, was passed by the Common Council and subsequently
vetoed by the Mayor, and
WHEREA~S',-rthe~ proposed: sale of a~ portion^ of .the former Lassa- --
lot~ was~ not submitted tu the Plan Commission for: review and-;-
recommendation, and; ...
WHEREAS, it is necessary to clarify the city's position regard-
ing this matter,
THEREFORE, BE IT RESOLVED, that the Common Council does hereby take
the following.position regarding the offer by Mr. Michael Nowitzke
to purchase- a por~tion of the Lassa lot.
1. The matter should be submitted to the Plan Commission for
recommen6a tion
2. The Park and Recreation Board should determine whether or
not it has any value for a public right-of-way
3. The Common Council will not consider selling~ the- property until it
has had an opportunity to consider the comments of the
residents in the area
4. The clerk is authorized to return Mr. Nowj~tzke's nonjes
he has sub,mitted with his offer to purchase and that 1.1~.
Nowitzke will also be reimbursed for the cost of the
Certified Survey Map
5. In the event the Comnon Council determines that it would
be i.n the best interest of all parties concerned to sell
the property new bids will be sought.
