CCR1979237RESOLUTION 8237-79 DENIAL OF CERTIFIED SURVEY MAP (D. Stemper) WHEREAS, Mr. Daniel Stemper has submitted a certified survey map pre- Pared by Kit Keokkanen, land surveyor, for a three-parcel division of the Eleanor B. Fons property (former.ly the Froelich property) on Gold Drive in the SE 114 of Section 5 and, WHEREAS, it is the general intent of the land division ordinance to regulate the division of land, and in part provides to: Lessen congestion in the streets and highways Further the orderly layout and appropriate use of land Prevent the overcrowding of land Restrict building sites on floodlands, shorelands, covered-bY-pOor Soils, or in other areas poorly suited for development parcels of land - and^-*-:-, .. Facilitate- the further division. of -large:. tracts .into smaller - - - hTHEREAS.,~. the Plan Commission has' -recommended- that :the.€ommon-= -.:. council not- approve the certified:-survey- bec cause- i,t has~i determined:-_^. that in accordance with^ Sec.: .7.1 of :the Land:.Division'Ordinance:it is . in the-best interest of the city not to permit accesses directly onto- a preliminary map required in Section 6.1 of the Land Division Ordinance and the necessary data required by Section 4.2 has not been submitted, the Plan Commission has not approved an-acceptable design and -layout for the. balqnce of the property. THEREFORE, BE IT RESOLVED, that. the Common Council of the City of Muskego upon the recommendation of the Plan Commission does hereby - deny the request for approval- of a certified survey map -for a 3-parcel division of the Eleanor B. Fons' property, submitted by Daniel Stemper. BE IT FURTHER RESOLVED, this denial is for the following reasons: * Gold Drive, which serves as an arterial street. Due.-to the..fact that 1. p preliminary plat as required in 6.1 of the Land Division Ordinance as well as the data required in Sec. 4.2 of that ordinance has not been submitted. e 2. The proposed division could jqopardize the orderly layout and appropriate use of the balance of the property owned by Mrs. Eleanor B. Fons. 3. Prohibiting direct access onto Gold Drive which serves as an arterial street when other options are available is in the best interest of either the City or the developer. 4.
