CCR1979191RESOLUTION #191-79 RESOLUTION DEFERRING PAYMENT OF ASSESSMENT FOR COSTS OF SEWER FOR THE GEORGE AND ALVIN SCHAEFER FARM LOCATED AT W187 S7791 LIONS OF WAUKESHA, STATE OF WISCONSIN. PARK DRIVE IN THE CITY OF MUSKEGO, COUNTY WHEREAS, the city currently has a special assessment lien for sewers on the following described real estate located within the City of Efuskego: The following described real estate in Waukesha County, State of Wisconsin: South half of the Southwest and Southeast 1/4 of Section 8 Town 5 North, Range 20 East, consisting of 138 acres, a/k/a the Schaefer Farm, City of Muskego. and WHEREAS, the owners of said real estate, George and Alvin Schaefer, have requested the City to defer said special assessments under the provisions of Section 66.605 Wisconsin Statutes, and WHEREAS, the said real estate is currently involved in litigation pending before the Wisconsin State Supreme Court and until the resolution of such litigation, said real estate cannot be sold or mortgaged, and WHEREAS, said George and Alvin Schaefer have made application to the city for an extension of time within which to pay the special assessments that have levied against said property, which consist of the following: $15,342.40 - special assessment $16,704.75 - special assessment 1,227.39 - interest 1,336.38 - interest $16,569.79 $18,041.13 NOW, THEREFORE, BE IT RESOLVED that the special assessments affecting the Schaefer property which were the result of certain sewer construction hereby are deferred for a period of two (2) years from this date, and BE IT FURTHER RESOLVED that while said special assessment is outstanding under the terms and conditions of this deferment the same shall bear interest at the rate of six (6%) percent per annum, and BE IT FURTHER RESOLVED that should the litigation which involves said property not have been resolved upon the expiration of eighteen (18) months from this date, then and in that event, said Schaefers may petition the Council of the City of Muskego and reapply for an extension.
