CCR1979174'. >RESOLUTION ir'174-79 CERTAIN FIN,DINGS CONCERNING TAX INCREPIENTAL DISTRICT A RESOLUTION CREATING, DESCRIBING AND MAKING 'NUMBER FOUR, CITY OF IIUSKEGO - - WHEREAS, the overall development of the central portion of the city of ~uskego is recognized as a major need of the City; and, (iHE,xEAS, the City of Muskego desires to create a tax incremental district, in accordance with the provisions of Section 66.46 of the ~i~consin Statutes (the "Tax Increment Law"), in order to provide a aDle method of financing the costs of needed public improvements for appropriate private developmsnt, including new dewelopnent and over~ll development of the central portion of the City; and improvement of existing development, which will contribute to the *t,in the said district and thereby create incentives and opporturities - ~~crement Law, the Planning Commission, on May 1, 1979, held a public hearing concerning the proposed creation of a tax incremental district in the City of Muskego, and thereafter! designated the boundaries of the proposed tax incrementdl district and recommended to the Common Council that it create such tax increment21 district within the area enclosed by the said boundaries, as specified in the WHEFEAS, in accordance with the procedures specified in the Tax 'undary description attached to this resolution 2s Exhibit A hereo of, d entitled "Boundary Description of Tax Incremental District Number City of Nuskego"; and WHEREAS, prior to its publication, a copy of the notice of the said public hearing was sent to the chief executive officers of the Waukesha County Board of Supervisors, the District Board of the Waukesha County Vocational, Technical and Adult Education District and the Chairman of the Board of District Commissioners of the Big entities having the power to levy taxes on property located within Muskego - BasBay Protective and Rehabilitation District (the other the proposed district) and the School Board of the Muskego-Noway School District (the school board of the school district which in- cludes property located within the proposed district), in accord- ance with the procedures specified ip the Tax Increment Law; and ?]OW, THEREFORE, BE IT RESOLVED BY THE COPIMON COUNCIL OF THE CITY OF piUSK;EGO, as fOllOWS: 1. Pvrsuant to the Tax Increrent Lao, ther-? is hereby crested !n the City of f.'ius%ego a t~x increnental discl-j~ct, to be kn0h.n 2s ?x Incremental Districi 1G~nber Four, CiCy of i-lcs!:eqo", the oundzries of which shall be Lhose recornended to the Corru~on Council y the Planning Co~nission, 2s specified in the attached Exhibit A. . 2. 1079. 3 The said tax incrementzl district is created 2s of January 1, The Common Council 3ereby finds and declares that: the said tax increment21 district is a "blighted area" (a) Not less than 25%. by area, of the real property within within tne meaning Of Section 66.46(2) (a) of the Kisconsin Statutes; and - significantly the value of all of the other real property (b) The improvement of such area is likely to enhance in the said tax incremental district; and (c) The aggregate value of equalized taxable property of the said tax increnenkal district, together with that of Tax Incremental District Number One, Tax Ineremental District Number Two, Tax Incremental District Number Three, Tax Incremental District Number Five, Tax Incremental District Number Six and Tax Incremental District Number Seven, does not exceed 5% of the total value of equalized taxable property within the City of Muskego, there being no more tax incremental districts in the City of Muskego. - $repare a Project Plan for Tax Incremental District Number Two, 4. The Planning Commission is hereby authorized and directed to pursuant to the provisions of Section 66.46(4) (d) of the Wisconsin Statutes, and to submit the said Plan to the Common Council for its review and approval. I 5. The City Clerk is hereby authorized and directed to apply to the Wisconsin Department of Revenue, in such form as may be prescribed, for a "Determination of Tax Incremental Base", as of January 1, 1979, Statutes. aursuant to the provisions of Section 66.46 (5) (b) of the Wisconsin 6. Thz City ?,ssessor j.s hereby a~uthorized and directed to identify upon the assessment roll returned and examined under section 70.45 of the Wisconsin Statutes, those parcels of property which are within Tax Incremental District Number Two, specifying Clerk is hereby authorized and directed to make similar notations on thereon the name of the said tax incremental district, and the City pursuant to Section 66.46(5) (f) of the Wisconsin Statutes. the tax roll made under Section 70.65 of the Wisconsin Statutes, edopted this day of September, 1979.
