I A RESOLUTION CREATING, DESCRIBING AND MAKING RESOLUTION $173-79 CERTAIN FINDINGS CONCERNING TAX INCREMENTAL DISTRICT 'NUMBER THREE, CITY OF MUSKEG0 WHEREAS, th? development of industrial sites in the City of Muskego is recognized as a major need of the City; and WHEREAS, the City of Muskego desires tc create a tax incremental .- district, in accordance with the provisions of Section 66.46 of the wisconsin Statutes (the "Tax Increment Law"), in order to provide a a able method Of financing the costs of needed public improvements thln the said district and thereby create incentives and opportuni- ties for appropriate private development, including new development and inprovenent Of existing developmsnt, which will contribute to development of industrial sites; and WHEREAS, in accordance with the procedures specified in the Tax Increment Law, the Planning Commission, on March 20, 1979, held a public hearing concerning the proposed creation of a tax incremental district and thereafter designated the boundaries of the proposed tax incremental district and recommended to the Common Council that it create such tax incremental district within the area enclosed by the said boundaries, as specified in the boundary description attached this resolution as Exhibit A hereof,. and entitled "Boundary zscription Of Tax Incremental District Number Three, City of Muskeoo"; WHEREAS, prior to its publication, a copy of the notice of the public hearing was sent to the chief executive officers of the Waukesha County Board of Supervisors, the District Board of the Waukesha County Vocational, Technical and Adult Education District and to the Chairman of the Board of District Comnissioners of the Little Muskego Lake Pirotective and Rehabilitation District (the other entities having the power to levy taxes on property located within the proposed district) and the School Board of the Muskego- Norway School 0-i-strict (the school board of the school district which includes property located within the proposed district), in accordance with the procedures specified in the Tax Increment Law; and Noh', THEREFORE, BE IT RESOLVED BY TIiE COFflON COUNCIL OF THE CITY OF MUSKEGO, a5 ~fOllOWS: a.s specified in 2. The Comnon Council hereby finds and declares that: (a) Bzsed upon its conslllting engineer's findings, not less than 25%, by arez, of the real property within the said tax incremental district is suitable for industrial sites within the mezning of Section 66.52 of the Wisconsin statutes; and (b) The improvement of such area is likely to enhance significantly the value _of all of the other real property in the said tax incremental district; and (c) The aggregate value of equalized taxable 'property of the said tax incremental d'istrict, together, with that of Tax Incremental District Number One, Tax Incremental District Number Two, Tax Incremental Dis-ict Number Four, Tax Incremental District Number Five, Tax Incremental District Number Six and Tax Incremental District Number Seven, does not exceed 5% of the total value of equalized taxable property within the City of Muskego, there being no more tax incremental districts in the City of Muskego- I 6 9 ?pare a Project Plan for Tax Incremental District Number Three, pursuant to the provisions of Section 66.46 (4) (d) of the Wisconsin Statutes, and to submit the said Plan to the Common Council for its review and approval. . 4. The Planning Commission is hereby authorized and directed to 5. The City Clerk is hereby authorized and directed to apply to a "Determination of Tax Incremental Base", as of January 1, 1979, the Wisconsin Department of Revenue, in such form as may be prescribed, pu fe suant to the provisions of Section 66.46 (5) (b) of the Wisconsin Statutes. 6. The City Assessor is hereby authorized and directed to Section 70.45 of the Wisconsin Statutes, those parcels of property identify upon the assessment roll retiii-ned and examine6 fiin2er which are within Tax Incremental District Number Three, specifying thereon the name of the said tax incremental district, and the City Clerk is hereby authorized and directed-to make similar notations on the tax roll made under Section 70.65 of the Wisconsin Statutes, pursuant to Section 66.46 (5) (f) of the Wisconsin Statutes.
