CCR1979172A RESOLUTION CREATING, DESCRIBING AND MAKING RESOLUTION #172-79 CERTAIN FINDINGS CONCERNING TAX INCREMENTAL DISTRICT NUMBER TWO, CITY OF MUSKEGO 9 WHEREAS, the development of industrial sites in the City of Muskego is recognized as a major need of the City; and district, in accordance with the provisions of Section 66.46 of the Wisconsin Statutes (the "Tax Increment Law"), in order to provide a , &+thin the said district and thereby create incentives and opportuni- viable method of financing the costs of needed public improvements ties for appropriate private development, including new development and improvement of existing development, which will contribute to development of industrial sites; and WHEREAS, the City of Muskego desires to create a tax incremental ! WHEREAS, in accordance with the procedures specified in the Tax Increment Law, the Planning Commission, on March 20, 1979, held a public hearing concerning the proposed creation of a tax incremental district and thereafter designated the boundaries of the proposed tax incremental district and recommended to the Common Council that it create such tax incremental district within the area enclosed by the said boundaries, as specified in the boundary description attached to this resolution as Exhibit A hereof, and entitled "Boundary escription of Tax Incremental District Number Two, City of Muskego"; end WHEREAS, prior to its publication, a copy of the notice of the said public hearing was sent to the chief executive officers of the Waukesha County Board of Supervisors and the District Board of the Waukesha County .Vocational, Technical and Adult Education District within the proposed district) and the School Board of the Muskego- (the other entities having the power to levy taxes on property located Norway Schooi District (the scnool boar6 of the 3Ci10Gi sistrict which includes property located within the proposed district), in accordance with the procedures specified in the Tax Increment Law; ii I( I OF MUSKEGO, as follows: NOW, THEREFORE, BE IT FESOLVED BY THE COMMON COUNCIL OF THE CITY a tax incremental district, to be known as "Tax Incremental District Number Two, City of Muskego", the boundaries of which shall be as specified in the attached Exhibit A. those recommended to the Common Council by the Planning Commission 1. Pursuant to the Tax Increment Law, there is hereby created - 2. The said tax incremental district is created as of January 1, 1979. I 3. The Common Council hereby finds and declares that: (a) Based upon its consulting engineer's findings, not less tax incremental district is suitable for industrial sites than 25%. by area, of the real property within the said within the meaning of Section 66.52 of the Wisconsin Statutes; and (b) The improvement of such area is likely to enhance significantly the value of all of the other real property in the said tax incremental district; and the said tax incremental district, together with that of (c) The aggregate value of equalized taxable property of Tax Incremental District Number One, Tax Incremental District Number Three, Tax Incremental District Number Four, Tax Incremental District Number Five, Tax Incremental District Number Six and Tax Incremental District Number Seven, does not exceed 5% of the total value of equalized taxable property within the City of Muskego, there being no more tax incremental districts in the City of Muskego. e 4 i' , . 4. The Planning Commission is hereby authorized and directed to a prepare a Project Plan for Tax Incremental District Number Two, ursuant to the provisions of Section 66.46(4) (d) of the Wisconsin tatutes, and to submit the said Plan to the Common Council for its review and approval. 5. The City Clerk is hereby authorized and directed to apply to the Wisconsin Department of Revenue, in such form as may be prescribed, for a "Determination of Tax Incremental Base", as of January 1, 1979, pursuant to the provisions of Section 66.46(5) (b) of the Wisconsin identify upon the assessment roll returned and examined under Section 70.45 of the Wisconsin Statutes, those parcels of property which are within Tax Incremental District Number Two, specifying thereon the name of the said tax incremental district, and the City Clerk is hereby authorized and directed to make similar notations on the tax roll made under Section 70.65 of the Wisconsin Statutes, pursuant to Section 66.46(5) (f) of the Wisconsin Statutes. 6.
