A RESOLUTION CREATING, DESCRIBING AND MAKING RESOLUTION #171-79
CERTAIN FINDINGS CONCERNING TAX INCREMENTAL DISTRICT
NUMBER ONE. CITY OF MUSKEGO
WHEREAS, the overall development of the southwest portion of the
City of Muskego is recognized as a major need of the City; and -
WHEREAS, the City of Muskego desires to create a tax incremental
district, in accordance with the provisions of Section 66.46 of the
isconsin Statutes (the "Tax Increment Law"), in order to provide a 1$ iable method of financing the costs of needed public improvements within the said district and thereby create incentives and opportunities
for appropriate private development, including n'ew development and
improvement of existing development, which will contribute to the
overall development of the southwest portion of the City; and
WHEREAS, in accordance. with the procedures specified in the Tax
Increment Law, the Planning Commission, on September 4, 1979, held a
public hearing concerning the proposed creation of a tax incremental
district in the City of Muskego, and .thereafter designated the
boundaries of the proposed tax incremental district and recommended
to the Common Council that it create such tax incremental district
within the area enclosed by the said boundaries, as specified in the (ss undary description attached to this resolution as Exhibit A hereof,

One, City of Muskego"; and

WHEREAS, prior to its publication, a copy of the notice of the
said public hearing was sent to the chief executive officers of the
Waukesha County Board of Supervisors and the District Board of the
Waukesha County Vocational, Technical a~nd Adult Education District
(the other entities having the power to levy taxes on property located
within ths' proposd district; an5 ?ne Szhool Zoarii of the ;.i~sksga-
Norway School District (the school board of the school district which
includes property located within the proposed district), in accordance
with the procedures specified in the Tax Increment Law;
NOW, THEREFORE, BE IT RESOLVED BY THE CO!4iiON COUNCIL OF THE CITY
OF MUSKEGO, as fOllows:
1. Pursuant to the Tax Increment Law, there is hereby created
in the City of Muskego a tax incremental district, to be knrwn as
"Tax Incremental District Number One, City of ?.:z<!;cq?'' t!le
(Ip undaries of which shall be thosG 1-ecommended to the Common Council
y the Planning Commission, zs specified in the attached Exhibit A.

2,. The said tax incremental district is created as of January 1,
3. The Common Council hereby finds and declares that:
the said tax incremental district is a "blighted area"
(a) Not les? than 25%, by area, of the real property within
within the meaning of Section 66.46 (2) (a) of the Wisconsin
Statutes; and
significantly the value of all of the other real property

in the said tax incremental district; and
the said tax. incremental district, together with that of

taxable property within the City of Muskego, there bging
no more tax incremental districts in the City of Muskego.

4. The Planning Commission is hereby authorized and directed to
prepare a Project Plan for Tax Incremental District Number One,
pursuant to the provisions of Section 66.46 (4) (d) of the Wisconsin
Statutes, and to submit said Plan to the Common Council for its
review and approval. I 5. The City Clerk is hereby authorized and directed to apply to ~ * for a "Determination of Tax Incremental Base", as of January 1, 1979, i
the Wisconsin Department Of Revenue, in such form as may be prescribed,
pursuant to the provisions of Section 66.46(5) (b) of the Wisconsin
Statutes.

6. The City Assessor is hereby authorized and directed to

Section 70.45 of the Wisconsin Statutes, those parcels of property
which are within Tax Incremental District Number One, specifying I
Clerk is hereby authorized and directed to make similar notations on
thereon the name of the said tax incremental district, and the City
the tax roll made under Section 70.65 of the Wisconsin Statutes,
pursuant to Section 66.46(5) (f) of the Wisconsin Statutes.
