CCR1979076RESOLUTION #76-79 RESOLUTION TO BECOME A PARTICIPATING MUNICIPALITY IN SEWER SYSTEM EVALUATIONS D D D n WHEREAS, On May 25, 1977 a judgement was entered in the Dane County Circuit Court accepting a stipulation agreed to by the City of Milwaukee Sewerage Commission, Metropolitan Sewerage Commission of the County of Milwaukee and of the State of Wisconsin; section B of the stipulation addressed the problem of wet weather bypassing in the separate sewer areas of the district and contract areas, and WHEREAS, The stipulation provides that the Commission will coordinate a district wide sewer system evaluation to be completed not later than July 1, 1980 and the report on the evaluation must identify corrective work that needs to be undertaken by the local municipality and a time scheduled for such work to- assure that it is'compieted by not later than July 1, 1986, and WHEREAS, Any municipality not meeting the established schedule additional waste loading denied by the Commission; shall have all requests for sanitary sewer extensions or NOW, THEREFORE, BE IT RESOLVED, By the Common Council of the City of Muskego that in order for the City of Muskego to become a "participating municipality" within the terms of City of Muskego does resolve to commit the City of Muskego section B of such stipulation, the Common-Council-of the to the correction of wet weather bypassing within its system and the City of Muskego will participate in the district wide sewer system evaluation and will implement the designated corrective program established as a result of those studies. BE IT FURTHER RESOLVED, That in the event sufficient federal or state funds are unavailable through the Commission to finance the designated corrective program, that the City of Muskego will provide necessary financing to assure the completion of its wet weather correction program by the date established in the sewer system evaluation or by July 1, 1986, whichever occurs sooner. BE IT FURTHER RESOLVED, That a copy of this resolution be forwarded to Gloria McCutcheon Chief Municipal Wastewater Section of the Department of Natural Resources and to the Milwaukee Metropolitan Sewerage Commission.
