CCR1979001RESOLUTION 81-79 i APPROVAL OF CONTRACT FOR RESCUE SERVICE WHEREAS, it is necessary for the City of Musker.0 and the Tess Comers Volunteer Fire Department to enter 'into an agreement whereby 'the Tess Corners Volunteer Fire Department will supply rescue service to the City of Muskego, .THEREFORE, BE I'T RESOLVED that the Common Council of the City of Muskego does hereby approve of a contract between the City of Muskego and the Tess Comers Volunteer Fire Department:. BE 'IT FURTHER RESOLVED that said contract will remain in effect until February 15, 1980 and that the Mayor and the City Clerk be authorized to execute the contract in the name of the city. THIS CONTRACT made and entered into this day of Y 19 9, by and between the TESS CORNERS VOLUNTEER FIRE DEPARTMENT, hereinafter referred to as the Fire Company and the CITY OF MUSKEGO, a municipal corpor- ai& of Waukesha County, Wisconsin, hereinafter referred to as Muskego. WITNESSETH : WHEREAS, the parties hereto are desirous of entering into an agreement whereby the Fire Company will furnish rescue and first aid services to all areas of the City of Muskego lying within the limits of the City of Muskego upon the terms and conditions hereinafter more particularly set forth. NOW, THEREFORE, in consideration of the mutual covenants and promises of each of the parties hereto and for other good and valuable consideration to the other paid, the receipt of which is hereby acknowledged, the lows : parties hereto do hereby covenant and agree, each with the other, as fol 1. The Fire Company agrees .to immediately furnish upon request the services of their rescue truck apparatus, equipment and men to promptly answer and respond to rescue calls coming from and pertaining to emergencies located within the City of Muskego. 2. The Fire Company agrees to keep and maintain in good working order and repair, properly housed at all times and at their sole cost and expense their rescue truck, apparatus and equipment and to keep trained personnel available and on call to man same. 0 3. The Fire Company further agrees to maintain adequate liability in- surance with the limits of said policy not to be less than $200,000.00 and $500,000.00 each occurrence and that the City be furnished a copy of said policy. 4. It is distinctly understood by all parties that the rescue service contracted for in this agreement is for emergency purposes only and that the Fire Company will not transport patients to hospitals unless there is a true emergency as determined by the Fire Company official in charge of rescue truck at the time of the call. 5. It is further understood that the Fire Company's rescue facilities shall not be used to transport parties to a hospital when other emergency aicles, such as the sheriff's department ambulance or other private ambulances are available. Y 1 ~, " - 2- I 6. The Fire Company shall keep an accurate and full report on all scue calls made and shall at least once a month submit such report to e the Common Council of Muskego. 7. As consideration for the foregoing covenants and agreements and &ices to be rendered and performed by the Fire Comp'any, Muskego agrees to pay the Fire Company and the Fire Company agrees to accept the following payments, to-wit: $60.00 per rescue call. 8. This contract shall commence as of the 15th day of February, 1979, and shall remain in full force and,effect for a period of one year I from said date and shall be automatical-ly renewed upon such anniversary 6 of said.date for additional periods of one year each, unless either of he parties hereto shall give to the other written notice of its desire o cancel and terminate same on February 15th of any year, such notice to be forwarded by registered mail at least thirty (30) days prior to the expiration of this contract or any renewal thereof.
