CCR1978064RESOLUTION #64-78 DENYING THE PETITION TO REZONE PARCEL OF LAND IN SECTION 4 FROM RS-1 TO RS-2 (M. Clifford Young) WHEREAS, the City has received a petition from Mr. M. Clifford Young to rezone a parcel of land located on the corner of Martin Drive and Southern Heights Drive from RS-1 to RS-2, and WHEREAS, the necessary public hearing has been. held, and ,< WHEREAS, Mr. M. Clifford Young presently owns-'a duplex located on the property which at the present time is a non-conforming use, and WHEREAS, Section 9.09 of the Muskego Zoning Ordinance does permit a duplex in a single family residential area as a Conditional Use, however, it requires that the lot area be doubled that..of -.single .family,: -and -. WHEREAS, the,Plan Commission has recommended denial of the request, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby deny the petition of M. Clifford Young, dated January 16, 1978, to rezone property located at 568 W16949 Martin Drive in Section 3 of the City of Muskego from RS-1 to RS-2 because the existing duplex located on the property is a non- conforming use and if it became a Conditional Use it would require double the land area required for single family purposes. ..
