CCR1977237RESOLUTION #237-77 DETERMINING THE CONSENSUS OF THE COUNCIL REGARDING THE POSSIBILITY OF INITIATING LEGAL ACTION AGAINST MUSKEG0 RENDERING COMPANY WHEREAS, the Public Welfare Committee has received several complaints from residents adjacent to or near the Muskego Rendering Company, Inc. regarding a serious odor problem and have had several meetings with the owners of the plant, the citizens and representatives of the Department of Natural Resources, and WHEREAS, the Welfare Committee has determined that the DNR problem and that the owners of the rendering company have has issued several orders in an effort to alleviate the waste water treatment facility which the DNR has indicated submitted to the DNR plans for the reconstruction of their will be approved in the near future, and WHEREAS, the committee has discussed with City Attorney Buckley violation of Section 10.03 of the Municipal Code (Public Nusiance) the possibility of citing the Muskego Rendering Company for or initiating a law suit against them, and WHEREAS, Mr. Buckley~-fias advised the committee that although in his opinion there is a violation of the municipal code he would have to recommend to the Common Council they do not initiate action against the company since, in his opinion, it would serve no purpose, and WHEREAS, the committee wishes to determine the opinion of the Common Council in this matter and have directed that a resolution be presented in order to gain that consensus, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego is of the opinion that the aggrieved parties do not want to close down the operation ,of the Muskego Rendering Company but are only interested in resolving the problem. BE IT FURTHER RESOLVED that the Common Council does hereby direct the^ City Attorney to work with the.Department of Natural Resources odors emanated from the Muskego Rendering Plant can be solved as and the Attorney General's Office in order that the problem of expeditiously as possible. BE IT FURTHER RESOLVED that in the event these efforts fail the City Attorney is directed to take whatever legal action he deems necessary to bring the Muskego Rendering Company into compliance with Section 10.03 of the city's Municipal Code.
