RESOLUTION PROVIDING FOR COUNTER OFFER ON OFFER
(Willard G. Wapp, Jr.)
TO PURCHASE LOT 6, BLOCK 2, MUSKEGO INDUSTRIAL PARK
WHEREAS, Willard G. Wapp, Jr. has presented to the Common Council
of the City of Muskego an offer to purchase Lot 6, Block 2, in the
Muskego Industrial Park, this offer to purchase dated July 29, 1977,
and
WEREAS, one of the terms of purchase is that the sum of Three
Thousand Dollars ($3,000.00), in addition to the One Thousand
Dollars ($1,000.00) earnest money payment, be paid to the City upon
acceptance of the offer and the balance of the purchase price be
paid in cash at closing, and
WHEREAS, it is in the best interest of all parties concerned to
ascertain whether or not the buyer is able to obtain financing to
construct the necessary building within a 12-month period.
THEREFORE, BE IT RESOLVED that the City of Muskego does hereby
make a counter offer upon said property, which counter offer, if
accepted, shall then constitute a contract between the parties,
if said counter offer is accepted in writing prior to August 31,
1977;
The counter offer is as follows;
The buyer will furnish to the City or the City's agent,
E. M. Boerke, Inc., prior to the 15th day of November, 1977, at
12:OO A.M. (midnight) a statement to the effect that the buyer has
obtained necessary financing to consumate the purchase of said lot
and to commence construction of the proposed roller rink within twelve
(12) months of November 25, 1977. Said statement shall be by a
reputible bank, savings and loan association, insurance company or
Officer Of said lending institution addressed to the City of Muskego,
other lending institution and shall be signed by a duly authorized
and shall make reference to the contract dated July 29, 1977.
