MODIFICATION OF LAND COVENANT FROM FOUNTAINWOOD
POOL ASSOCIATION
WHEREAS, on the 17th day of June, 1971, representatives of
the Fountainwood Pool Association executed a land covenant
in order that laterals would not have to be installed to
serve lots encompassing the Fountainwood Pool Recreation
Area, and
WHEREAS, the land covenant indicated that they would not use
the lots for residential purposes for at least 25 years, and
WHEREAS, the land covenant does permit modification of the
agreement by the Common Council, and
WHEREAS, the Sewer Committee has recommended to the Common
Council that the land covenant be modified to permit the
installation of two laterals to serve Lots 6 and 13, Block 19,
Fountainwood Subdivision, in order that they can be sold, and
WHEREAS, it is the intent of the Association to use the
money from the sale of the two lots to upgrade the recreational
center ,
THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Sewer
Committee, does hereby approve of the request of the Fountain-
wood Pool Association to modify the land covenant previously
executed by them in order that laterals could be installed
on Lots 6 and 13, Block 19, Fountainwood Subdivision.
BE IT FURTHER RESOLVED that this approval is subject to the
understanding that any additional sewer assessments, if any,
must be paid by the Association.
