APPROVAL OF ACCEPTANCE OF OWNERSHIP OF THE
SEWER SYSTEM AND HOLDING TANK FOR COUNTRY CLUB OAKS
PLANNED UNIT DEVELOPMENT
WHEREAS, Mr. Scott Krause, developer of Country Club Oaks Planned
Unit Development, has requested permission to use a single holding
tank which would serve the four parcels in the development, and
WHEREAS, the Public Welfare Committee has indicated a willingness
to recommend approval of said request to the Common Council, and
WHEREAS, Mr. Scott Krause has been advised by the State of Wisconsin
that approval of the single holding tank for his development is
dependent upon the city agreeing to accept ownership of the sewage
system including the holding tank, mains, etc. which would serve
the development , and
WHEREAS, the Welfare Committee has recommended to the Common
Council that they indicate a willingness to accept ownership
of the system subject to the negotiating of an acceptable
agreement between the city and Mr. Krause as it relates to
maintenance, repairs and the limitation of use,
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego does hereby indicate its willingness to accept the
sewage system which will be serving the planned unit development
known as Country Club Oaks.
BE IT FURTHER RESOLVED that the acceptance of the sewer system
will be subject to the execution of an acceptable agreement
between the city and Mr. Scott Krause. 4 ?
