RESOLUTION OF NECESSITY (Kattnig)

WHEREAS, public necessity demands that sanitary sewer service it
be extended within the City of Muskego and that the City acquire the
necessary permanent easements required for the extension of said sewer
service,
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the
1 City of Muskego, Wisconsin, that it is necessary in the public interest
that the following permanent easement in the following described lands
be acquired for the purpose of the extension of sanitary sewer mains
in, across, and upon said lands and that the attached Relocation Order
for the purpose of establishing, laying out, extension, construction,
reconstruction, improving, or maintaining of said sanitary sewers be
approved:
PERMAMENT SANITARY SEWER EASEMENT
A 60.00 foot wide strip of land being located in all that part 0 of the Southeast $ of Sect ion 1 I, Town 5 North, Range 20 East, City of
Muskego, Waukesha County, Wisconsin, the centerline of which is described
as fol lows:
Commencing at the Southeast corner of Bay Lawn Subdivision No. 2, a
recorded piat; thence North 4” 54‘ 30” East along the East line of
said plat, 30.10 feet to a point on the centerline of Roger Drive, and
the place of beginning of the centerline to be described; thence North
87O 40‘ 00” East 440 feet more or less to the Westerly right-of-way
line of Durham Drive and end of said centerline.
AN9 BE IT FURTHER RESOLVED, that the City Attorney and Mayor
are hereby authorized and directed to negotiate for the acquisition of the
permanent easements in said lands required for the extension of said
sewer mains, and in the event permanent easements in said lands can not
be obtained by negotiation, the City Attorney is authorized and directed
totake by condemnation those lands requi_red for said - easement.

BY THE COMMON COUNCIL OF THE CI’TY OF MUSKEGO
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, finds and
determines that:
The proper establishing, laying out, widening, enlarging,
extending, construction, reconstruction, and improvement and maintaining ’ of certain sanitary sewers located with in the City of Muskego requires
the acquisition of a permanent easement in lands shown on the map
hereto attached and marked “Sanitary Sewer System Map #9, City of
Muskego--Kattnig property”.
The Common Council of the City of Muskego, tkreby orders
that:
I. The said easement is hereby laid out and established to
the lines and widths as shown in said map;
2. The required lands or interest in said lands as shown on
the map shall be acquired - p~rsant to the Wisconsin Statutes.
