DENIAL OF LEGAL STATUS

WHEREAS, the Common Council of the City of Muskego hs been ,
petitioned for legal status for two lots located on College
Avenue by David Beierle, and
WHEREAS, the Plan Commission has recommended denial of same
for the following reasons:
1. This is an RSE District which requires 40,000 sq. ft.
lots if sewer is available and double lot size if
sewers are not available.
2. This area is not intended for sewer for several
years,
3. The lot on which the existing residence is located
is 34,583 sq. ft. and the lot for which legal status
is requested is 24,875 sq. ft. which is considerably
less than the lot size required if sewers were
available.
4. These lots are located in a predominantly undeveloped
area and to permit legal status for these substandard
lots would have a tendency to set a precedent for
future development.
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego does hereby deny, upon the recommendation of the
City Plan Commission, the request for legal status for two
lots on College Av,enue for the above stated reasons.
