CCR1976027I- I #: R.ESOLUTION #?.7-76 AUTHCR.IZING REFUND TO K'LNNETH L4RSE.N FOR CULVERT COST (S65 W13234 LongfeLlow Lane) WHEREAS, it is the City of Musk,ego's respons.ib.il;i.ty to properly size and arrange for Brookfield Culvert Co. to pk-ovide and place driveway culverts for new homes constructed in the C.ity of Muskego, and , to construct a new home on the northeast corner of Longfellow Lane WHEREAS, Mr. Kenneth Larsen had contract,ed with BieI..insk~i Builders and Saroyan Road faci.ng Longfe.L.Low Lane!, and WHEREAS, Bielinski Builders, on November 5, 1.974, obtained a building permit and paid $380.00 for the cul.vert i,nstalled by the City of Muskego, and WHEREAS, constructi-an of the basement was begun on November 21, 1974, includingexcavation, footings, basement walls, backfilling 0 and delivery of framing materials, and WHEREAS, only after considerable construc,t,.i.on was Mr. Larsen, and subsequently Bielinski Builders, not.if.ied that the c~ity had erred and the culvert had been placed fur his driveway, anU WHEREAS, the culvert as origina1.l~ sized amounted to a 30" pipe at a cost of $380.00, and WHEREAS, the resized culvert consisted of two 52" arched culverts at a cost of $1,300.00, said cu1.verts to accommodate not only tlie normal drainage on Longfellow L.ar,e but also the storm wa.ter carried through the main Fountainwood drainage dit:ch Irom New Berlin, and WHEREAS, the normal culvert as originally sized and placed at a cost of $380.~00 would accommodate the normal. dra.inage on L.ongfellow Lane, and WHEREAS, as the additional capacity of the rfsl.zed two 52" arched culvert is required to hand1.e the storm water from New Berlin through the Fountainwood Drainage d.i,tch, THEREFORE, BE IT RESOLVED that the C.i.ty of Musk.ego shall share the cost of the oversized culvert in the amount of $650.00.
