DENIAL OF DEBACK CLAIM
WHEREAS, the City of Muskego has received a claim from Harold R.
and Carol J. DeBack for $500.00 covering alleged losses due to
excessive storm water resulting from the construction of the
city's industrial park, and
WHEREAS, a report by the city's engineer indicates that as a
result of the construction of the city's industrial park the
watershed which directs storm water on his property actually
has been decreased, and
WHEREAS, the City Attorney has advised the city that the city
is not responsible if reasonable care has been taken by the
city so as to not adversely affect the party involved, and
WHEREAS, the Finance Committee has recommended denial of the
claim, and
WHEREAS, the Public Works Committee has also recommended
denial of the claim along with the suggestion that the city
take whatever reasonable steps are possible to minimize the
affect of any storm water drainage on adjoining property as
a result of the development of our industrial park,
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego, upon the reconmendation of the Public Works
Committee and the Finance Committee, does hereby deny the claim
of Harold R. DeBack and Carol 3. DeBack in the amount of
$500.00. /1
