DENIAL OF CLAIM FROM RAYMOND WALLNER
WHEREAS, the City of Muskego has received a claim from Raymond
Wallner for $170,000.00 covering alleged losses due to excessive
storm water resulting from the construction of the city's
industrial park, and
WHEREAS, a report by the city's engineer indicates that as a
result of the construction of the city's industrial park the
watershed which directs storm water on his property actually
has been decreased, and
WHEREAS, the City Attorney has advised the city that the city
is not responsible if reasonable care has been taken by the
city so as to not adversely affect the party involved, and
WHEREAS, the Finance Committee has recommended denial of the
claim, and
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego, upon recommendation of the Finance Committee,
does hereby deny the claim of Raymond R. Wallner, Agent for
Muskego Industrial Park, Inc. in the amount of $170,000.00.
