CCR1976006RESOLUTION #6-76 APPROVAL OF CONTRACT FOR RESCUE SERVICE WHEREAS, it is necessary for the City of Muskego and the Tess whereby the Tess Corners Volunteer Fire Department will supply Corners Volunteer Fire Department to enter into an,-agreement rescue service to the City of Muskego, THEREFORE, BE IT RESOLVED, that the Cmon Council of the City of Muskego does hereby approve of a contract between the City of Muskego and the Tess Corners Volunteer Fire Department. BE IT FURTHER RESOLVED that said contract will remain in City Clerk be authorized to execute the contract in the effect until February 15, 1977, and that the Mayor and the name of the City. Schaumberg ATTEST: 1/76 j e/pj k TESS CORNERS VOLUNTEER EIRE DEPARTMENT RESCUE CONTRACT tA THIS CONTRACT made and entered into this 13 day of 1976, by and between the TESS CORNERS VOLUNTEER FIRE DEPARTME referred to as the Fire Company and the CITY OF MUSKEGO, a municipal corpor- ation of Waukesha County, Wisconsin, hereinafter referred toas Muskego. WITNESSETH: WHEREAS, the parties hereto are desirous of entering into an agreement whereby the Fire Company will furnish rescue and first aid services to all areas of the City of Muskego lying within the limits of the City of Muskego upon the terms and conditions hereinafter more particularly set forth. e NOW, THEREFORE, in consideration of the mutual covenants and promises of each of the parties hereto and for other good and valuable consideration ,each to the other paid, the receipt of which is hereby acknowledged, the parties hereto do hereby covenant and agree, each with the other, as follows: 1. The Fire Company agrees to irmnediately furnish upon request the services of their rescue truck apparatus, equipment and men to promptly answer and respond to rescue calls coming from and pertaining to emergencies located within the City of Muskgo. 2. The Fire Company agrees to keep and maintain in good working order and repair, properly housed at all times and at their sole cost and expense their rescue truck, apparatus and equipment' and to keep trained 0 personnel available and on call to man same. 3. The Fire Company further agrees to maintain adequate liabtlity in'suraiice with the limits of said policy not to be less than $200,000.00 and $500,000.00 each occurrence and that the City be furnished a copy of said policy. ~. It is distinctly understood by all parties that the rescue service contracted for in this agreement is for emergency purposes only and that the Fire Company will not transport patients to hospitals unless there is a true emergency as determined by the Fire Company official in charge of the rescue truck at the time of the call. -2- 5. It is further understood that the Fire Company's rescue facilities e shall not be used to transport parties to a hospital when other emergency vehicles, such as the sheriff's department ambulance or other private ambulances are available. 6. The Fire Company shall keep an accurate and full report on all rescue calls made and shall at least once a month submit such report to the Common Council of Muskego. 7. As consideration for the foregoing covenants and agreements and services to be rendered and performed by the Fire Company, Muskego agrees to pay the Fire Company and the Fire Company agrees to accept the following payments, to-wit: $50.00 per rescue call. 8. This contract shall cornmenbe as of the 15th day of February, 1976, and shall remain in full force and effect for a period of one year from said date and shall be automatically renewed upon such anniversary of said date for additional periods of one year each, unless either of the parties hereto shall give to the other written notice of its desire to cancel and terminate same on February 15th of any year, such notice to be forwarded by registered mail at least thirty (30) days prior to the expiration of this contract or any renewal thereof.
