CCR1975165RESOLUTION 11165-75 e AMENDMENT TO LEASE AGREEMENT BE'IWEEN ALFRED BADERTSCHER CITY OF MUSKEGO A WHEREAS, the Common Council on May 27, 1975, adopted Resolution 11143-75 Authorizing Execution of Lease between the City of Muskego and Mr. Alfred Badertscher, and WHEREAS, Mr.Badertscher has advised the Finance Committee that the cost of constructing a fence which would sufficiently protect the streams and springs from grazing cattle was such that a five year term would be necessary, and WHEREAS, the Finance Committee has recommended that the lease be amended to have the lease be extended to five years, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego does hereby approve of the following amended as follows: RENTAL: The rental of szid property shall be the sum of $200.00 per year, comencing on the 1st day of June, 1975, and ending the 31st day of May, 1980. BE IT FURTHER RESOLVED that the extended term of the lease is given with the understanding that in the event the land being leased is needed for the public good the lease shall be terminated at no cost to the city. Schaumberg City Clerk w LEASE AGREEMENT a A THIS AGREEMENT is made between the City of Muskego, Lessor, and Alfred Badertscher, Lessee: The property which is the subject of this lease is described as follows, to-wit: 26 acres of the former Grober property as shown as the outlot in The Ridges Subdivision 6. RENTAL: The rental of said property shall be the sum of $200.00 for a term of one year, corrnnencing on the 1st day of June, 1975, and ending the 31st day of May, 1976. PURPOSE OF LEASE: The Lessor leases the premises and the Lessee agrees to use the premises for the grazing and pasturing of livestock owned by the Lessee. CONDITIONS: Lessee shall prior to the use of the premises as above described and stated, erect fences which shall be sufficient provided to the premises shall be secured by locks and Lessee shall be responsible for the maintenance and repair of said fences at all times. Any fences or other equipment used by the Lessee during the term of the lease or a renewal thereof shall at the option of the city be removed by him at the expiration thereof. a- to keep the livestock within the confines of said fences. Any gate Lessee shall control all noxious weeds. Lessee shall be whatever means necessary (fence, etc.) protect the stream and several large springs from damage by livestock. LIABILITY INSURANCE: Lessee, shall at his own expense, at all times during the term of this lease, maintain in force a policy or policies of insurance, written by one or more responsible insurance carriers, which will insure Lessor against liability for injury to or death of persons or loss or damage to property occurring in or about the demised premises. The liabiiity under such insurance shall not be less than $100,000 forpny one person killed or injured, $200,000 for any one accident and $50,000 property damage. ASSIGNMENT: This lease shall not be assigned by the Lessee without the express written consent of the City of Muskego. RENEWAL: This lease is not subject to automatic renewal, but may be renewed by the Common Council on an annual basis upon such terms and conditions as the parties may agree to.
