ESTABLISHING PROCEDURE FOR LEASE OF GARDEN PLOTS
FROM THE CITY OF MUSKEGO
WHEREAS, on March 11, 1975, the Common Council adopted
Resolution 865-75 directing the Public Welfare Committee to
prepare plans for citizens to use city-owned property for
garden plots, and
a
a WHEREAS, the Welfare Committee has recommended that an agreement
be prepared which could be executed by the person leasing a
parcel of land, and
WHEREAS, it is recommended that the following provisions be
provided in the agreement:
(1) City to charge $15.00 for each lot.
(21 The city will prepare the ground for planting (but will
not fertilize)
(3) Provide immunity to the city from any liability claims.

(4) Each plot would be 50' x 50'.
(5) Term of lease to be May 1st to November 1s t.
(6) The lessee must be a resident or property owner of the
City of Muskego.
(7) The lessee must be at least 18 years or older or if
younger a parent or guardian must execute the agreement.
(8) The city would not be liable for crop loss.
(9) Each plot to be kept reasonably free of weeds.
(10) It would be the intent of the city to provide a plot to
those individuals who would use the produce for home use
and not commercial use.
(11) Rental is limited to one lot per family. Requests for
larger plots by organizations or groups of individuals
would be given special consideration.
and
WHEREAS, time is of the essence if use of the land is to be for
this coming growing season,
THEREFORE, BE IT RESOLVED that the City Attorney is directed to
draft an agreement with the above provisions.
BE IT FURTHER RESOLVED that the Public Welfare Committee is directed
to take the necessary steps to prepare the plots for use and to make
known their availabiLity to the citizens of the community.
