DIRECTING CITY ATTORNEY TO PREPARE NECESSARY
DOCUMENTS FOR ASSESSMENT
PROCEEDINGS
(W. Tower Drive)
WHEREAS, on September 24, 1974, the Cormnon Council of the City
of Muskego adopted Resolution 8231-74 which declared its intent
to have Tower Drive become a public right-of-way, and
WHEREAS, this action was taken upon the recommendation of the
Public Works Committee who reported the willingness of Mr. Morton
Smith to quit claim the necessary land to the city and a willingness
of the residents on the street to pay an assessment of $220.00 to
cover a part of the cost of resurfacing the road, and
WHEREAS, on November 7, 1974, a communication was sent to all
residents on the road explaining the city's policy of not accepting
private roads without assessing the costs of bringing the road
to city standards, and
WHEREAS, the Public Works Cormnittee has previously directed the
City Clerk to bill the residents living on Tower for the cost of
resurfacing the road ($220.00), and
WHEREAS, as of February 20, 1975, no monies have been received
and objections by some of the residents living on the road have
been raised, and

WHEREAS, the Public Works Committee is of the opinion that the
necessary legal steps should be taken to assess the owners of
property on W. Tower Drive for the cost of bring the road up to
city standards,
THEREFORE, BE IT RESOLVED that the Cpmmon-Counci1,of the City of 1
Muskego does hereby direct the City Attorney to research the matter
and provide the Council with whatever documents are necessary to
1. begin the assessment procedure.
