RESOLUTION VACATING SPECIAL ASSESSMENTS ON
LOTS IN JEWEL CREST SUBDIVISION
a WHEREAS, the Common Council levied special assessmerts
by final resolution dated May 26, 1970, in the "F" District
in the Northwest area as follows:
Lot 3, Block 19, Jewel Crest Subdivision $ 663.75
Lot 4, Block 19, Jewel Crest Subdivision $I ,337.25
AND, WHEREAS, it has been brought to the attention
of the Common Council that use of the sewer installations on
said lots is not feasible because said lots are substandard
lots under the zoning ordinance of the City, and,
WHEREAS, the present owner has agreed to combine
e said lots so as to make them one lot for building purposes and,
WHEREAS, an assessment upon said properties as a
single lot at the time the assessments were made would have
been in the amount of $1,549.07,
THEREFORE, BE IT RESOLVED, that upon the filing by
the owner tkreof of a waiver of special assessment notice and
hearing regarding an assessment of $1,549.07, as herein stated,
against said lots, and upon evidence given to the City and
approved by the City Attorney that said lots have been combined
into a single lot for building purposes, and upon the adoption
of a resolution levying a special assessment on said property
in the amount of $1,549.07,
BE IT RESOLVED, that the special assesments levied
against said Lots 3 and 4, Block 19, Jewel Crest Subdivision,
by final resolution dated May 26, 1970, be vacated.
BE IT FURTHER RESOLVED, that if the property owner
has made any payments on said assessments, that said payments
be credited against the new assessment of $1,549.07 to be levied.
