CCR1975040RESOLUTION 1140-75 (AS AMENDED) 0 RE-ESTABLISHING GUIDELINES FOR DEVELOPMENTS PLANNED FOR CITY OF MUSKEGO WHEREAS, on the 23rd day of November, 1971, the Common Council adopted Resolution 8220-71 establishing guidelines for approval of new develop- ments which would be using the city's sewage facilities, and -*WHEREAS, the following guidelines were established: 1. Proposed developments within the sewer assessment district will be given priority with particular consideration given to those lands which did not receive a deferred assessment. 2. All developments, except those on city-owned property, will be limited to 65% of the permitted density as established by the Zoning Ordinance. 0 3. No development will be approved if when 65% complete could not be adequately served by existing sewerage treatment facilities. In determining treatment capacity available, existing commitments by the city as well as recorded lots will be taken into consideration. 4. The Common Council will be receptive to developments outside of the sewer assessment district if provisions are made to treat the resulting wastes in off-peak hours so as not to overextend the treatment facility's capacity. and WHEREAS, on the 12th day of February, 1974, the Common Council adopted Resolution #26-74 re-affiming these guidelines, and WHEREAS, a review of the volume of sewage presently being treated by the northeast and northwest treatment plant has revealed that additional sewage treatment capacity (over and above that committed) was available, and lpE REAS, on the 27th day of August, 1974, the Common Council did approve amendment to the developer's agreement which permitted the full develop- ment of Hale Park Meadows, and WHEREAS, the Sewer Committee, as a result of their ,review, has recommended that an updated policy regarding approval of new developments which will be using the city's sewage facilities should be adopted by the Common Council, THEREFORE, BE IT RESOLVED that the Common Council, upon the recommendation of the Sewer Committee, does hereby adopt the following guidelines when considering new developments which would be using the city's sewerage facilities: a 1. All development in excess of 15 units (or seven acres) which would use city sewage facilities will be limited to 65% of the permitted density as established by the Zoning Ordinance. Redivision of lands for the purpose of circumventing the above guidelines would be prohibited by the Common Council. 2. No development will be approved if when 65% complete could not a be adequately served by existing sewage treatment facilities. Page 2 0 3. e 4. 5. 6. No extension of the existing sewer system for the purpose of opening new lands for development would be permitted by the city until metropolitan sewage treatment is available or a satisfactory alternate method of treatment is found. Each new development falling under the 65% limitation will require the execution of an agreement acknowledging the same. A periodic review of the effectiveness of each of the city's two treatment facilities will be made by the Sewer Committee to determine whether or not amendments to the 65% limitations are warranted. Prior commitments such as vacant lots, developments, existing residences, etc. shall be given priority to use existing sewer mains or interceptors. & BE IT FURTHER RESOLVED that the Common Council of the City of Muskego does ereby declare its intent to continue to monitor the growth of the community as not to over burden the capacity of its sewage treatment facilities to such a degree as to jeopardize the quality of water in the outlet streams.
