ACCEPTING TOWER DRIVE AS A PUBLIC
RIGHT-OF-WAY
WHEREAS, The Common Council, on June 11, 1974, adopted
Resolution 11110-74 declaring its intent to have Tower
Drive become a public right-of-way, and
WHEREAS, the Public Works Committee has described the
right-of-way and has advised the residents in the area
that an assessment of $220.00 will be made to cover a
part of the cost of surfacing the road, and
WHEREAS, the owner of the right-of-way, Mr. Morton Smith, Sr.,
has agreed to execute the necessary quit claim deed,
THEREFORE, BE IT RESOLVED that the Cmon Council of the
City of Muskego does hereby declare Tower Drive a public
right-of-way.
BE IT FURTHER RESOLVED that this declaration is subject
to the execution of the quit claim deed by Mr. Morton
Smith, Sr.
BE IT FURTHER RESOLVED that this declaration is also
subject to the understanding that an assessment of $220.00
shall be levied against each property owner to cover a
portion of the cost of surfacing,.
