CCR1974190RESOLUTION #190-74 DIRECTING THE CITY ATTORNEY TO DRAFT AN ORDINANCE AMENDING SEC. 12.01(5) (C) of the MUNICIPAL CODE WHICH WOULD RAISE THE QUOTA FOR CLASS "B" FERMENTED MALT BEVERAGE LICENSES FROM 38 TO 39 U WHEREAS, on August 13, 1974, the Common Council of the City of Muskego defeated an ordinance which would have amended Sec. 12.01 (5) (G) of the Municipal Code by removing the limitation on Class "B" Fermented Malt Beverage Licenses (retail beer licenses) which was recommended by the Rules, Laws and Ordinance Committee, and WHEREAS, it appeared that much of the opposition was based on the total removal of all control of the number of licenses issued, and WHEREAS, the City presently has 38 Class "B" Fermented Malt Beverage Licenses which are only issued in conjunction with the 38 Class "B" Intoxicating Liquor Licenses (taverns, supper clubs and dance halls) and WHEREAS, the City has presently on file an application for a Class "B" Fermented Malt Beverage License from James Welniak who is contemplating the opening of a small brats and pizza restaurant in the Parkland Plaza Shopping Center and WHEREAS, the recently adopted age of majority permits indi- viduals 18 years old to consume both fermented malt beverage and intoxicating liquor and therefore, the concern of pro- viding beer to individuals between the years of 18 and 21 is no longer valid, and WHEREAS, a small restaurant of this nature could be an asset to the community fulfilling a need for those who may not wish to patronize taverns, supper clubs, etc. THEREFORE, BE IT RESOLVED that the Cormnon Council of the City of Muskego does hereby direct the city attorney to prepare the necessary amendment to Ch. 12.01 which would raise the Class "B" Fermented Malt Beverage Licenses in the City of Muskego from 38 to 39.
