APPROVING AN AMENDMENT TO THE SUBDIVISION
AGREEMENT FOR HALE PARK MEADOWS
WHEREAS, the City of Muskego has recieved a request from the
developers of Hale Park Meadows Subdivision to amend the
subdivision agreement adopted August 31, 1972 whereby there
was placed a 65% limitation on the number of lots which
could be developed, and

WHEREAS, in Section 8 of that agreement the owners acknowledges
the guidelines established by Resolution #220-71, and
WHEREAS, the agreement further states that the owner acknowledges
that the city has applied those guidelines to the Hale Park
Meadows Subdivision, and
WHEREAS, the agreement further provides that the owner reserves
the right to seek reconsideration of this determination at any
c time after NW%nber 18, 1973, and that the city re-affirms that
it will diligently investigate the possibilities of expanding the
capacity of its sewerage treatment facilities and take whatever
action is necessary, within good planning concepts and economic
feasibility, to provide adequate sewerage treatment facilities, and
WHEREAS, a recent analysis of the northeast treatment facility by
the engineering firm of Ruekert & Mielke has determined that the
plant efficiency for BOD removal is 97.4% and suspended solids
removal is 97.2% and the sewerage flow into the northeast plant
during the month of ’une averaged 350,000 gallans per day, and
WHEREAS, it has been recommended by the engineering firm of Ruekert
and Mielke that additicnal connections be permitted on a schedule
which would call for a review of plant operations at least once
every six months, and
WHEREAS, the Se:wer Committee is of the opinion that the balance of
the lots in the Hale Park Meadows Subdivision could be built upon
without adversely affect~ing the northeast treatment system and
that the subdivision agreement between the developers of Hale Park
Meadows and the city could be amended to permit the development
of said lots,
THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the recommendation of the Sewer Committee, does hereby
amend the subdivision agreement between the developers of Hale Park
Meadows and the City of Muskego by striking Section 8 of that
agreement.
BE IT FURTHER RESOLVED that the City Attorney is directed to take
the necessary steps to amend said agreement.
