RESCINDING ACTION TAKEN ON RESOLUTION 1\3-73, AS
AMENDED, REGARDING THOMAS LANDFILL PEFMIT
WHEREAS, the Common Council of the City of Muskego adopted
Resolution 1/3-73 on January 23, 1973, which granted a solid
landfill permit to Thomas Disposal Co. subject to the
following conditions:
1. That he also received a permit from the Department of
Natural Resources.
2. That in order to provide adequate screen and to insure
the use of the premises by only authorized persons a fence
acceptable to the Plan Commission shall be provided along
Tans Drive.
3. That a $35,000.00 bond be provided to the City of Muskego.
4. That assurance be provided that proper equipment will be
on the premises to insure compaction and coverage.
5. That the hours of operation of the landfill be limited to
7:30 A.M. to 5:30 P.M.
6. That no operation will take placed on Sundays.
7. That there is strict compliance to Ordinance #194 (An
ordinance requiring the licensing of and regulating landfill
disposal sites) where applicable.
8. That the material being hauled to the site does not contain
any food particles or putrescible material.
9. That it is the understanding of Mr. Thomas and the City of
Muskego that the total restoration of the site by solid landfill
method will be completed in three years.
10. That "NO Trespassing" or "Danger" signed be placed on the
west property line.
and,
whereas, several months have passed and Mr. Thomas has failed..in
his efforts to acquire the necessary state permit, and
WHEREAS, it is the opinion of the Welfare Committee that Mr. Thomas
has been given ample opportunity to meet the conditions set forth
in Resolution 1/3-73 and have therefore recommended to the Common
Council that the action taken in Resolution 1\3-73, As Amended, be
rescinded,

Page 2. ~.. THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego does hereby rescind their action taken on January 3, 1973,
in Resolution 1/3-73.
BE IT FURTHER RESOLVED that this action is taken due to the failure
of Mr. Norman Thomas of Thomas Disposal Co. to meet the conditions
established in that resolution. h
