CCR1972246RESOLUTION # 246-72 (As Amended) APPROVING THE AGREEMENT BETWEEN ACME DISPOSAL, WAUERS AND THE CITY OF MUSKEG0 0 WHEREAS, the City of Muskego has been negotiating an agreement with Acme Disposal Co. and the Wauers for a Landfill Permit on lands presently owned by Mr. Carl Wauer, and WHEREAS, the Common Councll adopted Resolution #212-72, As Amended, which indlcated their willingness to consider an agree- Wment subject to several basic provisions, and e WHEREAS, the Public Welfare Committee has reviewed the proposed agreement and has suggested several changes and additions, THEREFORE’, BE IT RESOLVED that the Common Counci 1 of the City of Muskego does hereby approve of the agreement between, the City of Muskego, Carl and Lydia Wauer and Waste Management of Wisconsin subject to the following: 1. An addition to the contract which will provide that in the event a more economical and efficient method of disposing of refuse 1s found which is mutually agreeable to ail parties this contract can be reopened for new negotiations. 2. That because Acme and the City of Huskego recognizes the need to continue the exploration of the effectiveness and acceptability of recycling, they will agree to provide at the landfill site containers and “on premisell supervislon of recyclable material and will work with the city in in connectlon with city sponsored programs for the collection connection with any such programs to be developed. The provisions herein shall be on a trial basis for a term of one year and it is a reed that at the end of the one year period the program w 4 11 be evaluated by the city and Acme. Anv orofits made from this program shall be used for lake reklkmation. 3. Article 3, Section 3.1 (a on or before February 28, on or before February 28, 4. Article 3, Section 3.10 - hours of oDeration at the ) the sum of $13,000.00 will be paid 1973. (b) the sum of $13,000.00 1974. Hours of Operatlon will read, the 7:30 A.M. to 5:30 P.M. on Monday through Friday and from 7:30 A.M. to 5:30 P.M. Saturday. In the event of extra- ordinary circumstances due to weather or breakdown of equip- ment, those hours can be extended if an emergency can be shown by approval of the Mayor. ~~~ ~ site shall be confined to the hours e BE IT FURTHER RESOLVED that if the above changes or additions are agreed upon, the Clerk and Mayor are authorized to execute the necessary documents in the name of the clty.
