CCR1972212RESOLUTION #212-72 (As Amended) AUTHORIZING THE DRAFTING OF AN AGREEMENT BETWEEN AND LYDIA AND CARL WAUER THE CITY OF MUSKEGO, WASTE MANAGEMENT, INC. WHEREAS, the City of Muskego has received a request for a Landfill Permit from Carl and Lydia Wauer, and WHEREAS, the Public Welfare Committee has met with their representatives to work out a satisfactory agreement prior to issuance of the permit, and WHEREAS, the Welfare Committee is submitting to the Council for their con- sideration the major items which they feel must be agreed upon before the final execution of any agreement, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego does hereby declare its willingness to consider granting a Landfill Permit to Lydia and Carl Wauer. BE IT FURTHER RESOLVED that the granting of the Sanitary Landfill Permit will be dependent upon the execution of an agreement which will include, but is not limited to, the following: * 2. 1. 3. 4. 5. 6. 7. 8. The permit will cover an area of approximately 75 to 80 acres. A fee of $5,000.00 per year will be paid to the City of Muskego subject to the provisions however, that the fee may be subject to review in the event there is a substantial reduction of tonnage whereby the daily amount does not exceed 200 tons hauled to the site as a result of a loss of contract that Waste Management, Inc. presently has with the City of Milwaukee and the tonnage involved is not replaced. The agreement will cover a 10-year period. Free dumping to all citizens of the City of Muskego for the term of the agreement . The City will be reimbursed $26,000.00 as follows: $13,000.00 to be paid in February, 1973. The balance to be paid in equal payments during the years of 1974 and 1975. The use of approximately 20 acres of land which is not part of the Landfill Permit for clay material which is to be used as a liner and the assurance that there will be no excavation below the grade of the established restoration plan of the area. That the northerly area of property owned by Carl Wauer and constituting approximately 35 acres will be used exclusively for its cover material and excluded from the land covered by the permit. Which would limit the amount of refuse that could be dumped by Acme to no more than 600 tons per working day. BE IT FURTHER RESOLVED that the Public Welfare Committee and the City Attorney are directed to develop the necessary agreement and present it to the Council , for their approval. @ DATED THIS 14 DAY OF ..
