CCR1972204RESOLUTION 11204-72 RETURNING A PORTION OF WOODS ROAD BACK TO ITS ORIGINAL RIGHT-OF-WAY (Frank DeAngelis) WHEREAS, as a result of a division of land the former Dorothy Boldt property conveyed to the city 40 feet of right-of-way for road purposes, and WHEREAS, it has been determined by the City Engineer's drawings that it is feasible to return a portion of Woods Xoad back to its original right-of-way from Frank DeAngelis's west property line approximately 299.54 feet east along the south side of Woods Road, and WHEREAS, it has caused a hardship and Frank DeAngelis has requested that the city re-establish the dedicated right-of-way in the vicinity of the barn to its original width, and WHEREAS, the Public Works Committee has considered the request and re-affirmed its original decision to allow the dedication of 40 feet to remain and thus deny the request, and WHEREAS, the Alderman of the Sixth Ward feels that that decision must come from the Common Council, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego does hereby grant the request of Mr. Frank DeAngelis to re- establish the right-of-way of Woods Road in the vicinity of his barn to reflect the original right-of-way. BE IT FURTHER RESOLVED that the City Attorney is directed to take whatever steps he feels necessary to carry out this action and that the Mayor and City Clerk sign the necessary document.
