SETTING FORTH THE COUNCIL'S POSITION AS IT RELATES
TO LEASE AGREEMENT WITH CARL & LYDIA WAUER

WHEREAS, on November 12, 1968, the Common Council of the City of
Muskego approved of a lease agreement between Carl Wauer and Lydia
Wauer and the City of Muskego for the use of certain lands as a
public dump site for the benefit of the citizens of Muskego, and
WHEREAS, the lease agreement states that the lessors, Carl Wauer
and Lydia Wauer, lease to the City of Muskego 33 acres of land
and will maintain and operate the dump for $13,000.00 per year
through October 1, 1973, and
WHEREAS, the Common Council of the City of Muskego is of the opinion
that the 33 acres leased by them was meant for the exclusive use of
its citizens, and
WHEREAS, the present use of the dump includes people and individuals
residing outside of the city limits of the City of Muskego, and
WHEREAS, the Common Council feels it is necessary to clarify their
position in this matter,
THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego does hereby notify Carl Wauer and Lydia Wauer that it is
the Council's opinion that the city's exclusive rights to a 33
acre dump site leased by the city have been violated.
BE IT FURTHER RESOLVED that the lessors take immediate action to
assure the provisions of the lease agreement as it relates to the
exclusive rights of the citizens of Muskego to the leased area for
dumping purposes.
