CCR1972191RESOLUTION #191-72 RESOLUTION LEVYING SPECIAL ASSESSMENT ON PROPERTY IN ASSESSMENT DISTRICT H-8 (Laabs) i 3 WHEREAS, a request has been made by the owner thereof to allow him to connect to the sanitary sewer main fronting the real estate described: All that part of the Northeast 1/4 Section 8, Town 5 North, Range 20 scribed as follows: Commencing at the point of intersection of the North line of Hillview Drive and the centerline of Hillendale Drive; thence North 25O 17' 10'' East along the centerline of Hillendale Drive, 59.92 feet; thence North 14O 21' 05" East along said centerline, 283.68 feet; thence South 77' 07' East, 33.00 feet to the place of beginning of lands hereinafter described; thence continuing South 77' 07' East, 223.5 feet; thence South 13' 35' 26" West, 75.0 feet more or less; thence North 77O 07' West, 92.0 feet more or less; thence Southwesterly 111.0 feet more or less; thence Northwesterly, 131.0 feet more or less to the East line of Hillendale Drive; thence North 14' 21' 05" East along the East line of Hillendale Drive, 186.00 East, City of Muskego, Waukesha County, Wisconsin, bounded and de- feet to the place of beginning. and WHEREAS, a Waiver of Notice of Special Assessment and Hearings and the levying thereof has been filed with the City Clerk by the owner; NOW, THEREFORE, BE IT RESOLVED: (1) For the purpose of paying a portion of the cost of the construction and installation of a sanitary sewer collection system within the City, there is hereby levied and assessed against the above described real estate the sum of $2,829.70, being the assessment for the installation of an eight-inch sanitary sewer main having an average depth of ten feet. (2) There is further assessed the actual cost of the instal- lation of a sewer lateral to serve said real estate together with the incidental costs of said installation, including attorney and engineering fees and publication fees, if any. (3) Said assessment may be paid in ten annual equal installments, the first installment being due on the 1st day of November, 1972, and subsequent installments annually thereafter. Interest at the rate of eight (8%) per cent per annum on the entire assessment shall be charged. The first installment due shall include interest on the entire assessment from the date hereof to the 31st day of December, 1972. Subsequent installments shall include one year's interest upon the unpaid balance of the assessment. *' (4) The City Clerk is directed to give notice of this assess- ment by mailing a copy of this resolution to the owner of the property at his last known post office address or by personal service upon the owner . (5) If the owner of the property shall file with the City Clerk within thirty days from the mailing or service of the aforesaid notice, a written notice that they elect to pay the special assessment upon their property on or before November 1, 1972, special assessments payable in installments shall not be made against said property of such owners, and the owners shall pay the entire assessment when due. (6) In the event a person so elects to pay such assessment on or before November 1, 1972, but fails to do so, the entire amount to December 31, 1972, at the rate of eight (8%) per cent per annum, which shall be entered on the tax roll for the year 1972 and collected as are other taxes of the City, on a ten year installment basis. of such assessment together with interest thereon from date hereof (7) After the time for making such election shall have expired, such assessment shall be due and payable in installments as aforesaid, but any assessment may be paid in full before due only upon the payment of interest to date of prepayment upon such assessment plus one year's interest on the then unpaid principal amount of such assessment.
