CCR1972187RESOLUTION #187-72 DECLARING ITS INTENT TO INITIATE A PETITION TO REZONE CERTAIN LANDS IN SECTIONS 11 AND 12 ALONG MCSHANE ROAD WHEREAS, a petition by Harold DeBack and Jean Wallner for rezoning properties owned by them from 1-2 and RS3 to RSA with an OPD has been denied, and WHEREAS, the petitioners have requested that the Plan Commission recommend to the Council the type of zoning they feel would be acceptable in that area, and WHEREAS, the Plan Commission, at its meeting of September 5, 1972, has recommended that the Council initiate on its own motion a petition to rezone those lands along McShane Road in Sections 11 and 12 as follows : Lands presently zoned RS3 to RS2 Lands on the south side of McShane Road from 1-2 to RS2 Lands on the north side of McShane Rd. presently zoned 1-2 to RS2, except that 31.9 acres of land owned by Harold DeBack and Jean Wallner be rezoned to ELSA and WHEREAS, it was further recommended by the Plan Commission that the lands covered by this rezoning owned by Harold DeBack and Jean Wallner carry an OPD, and WHEREAS, the Council wishes to indicate that it would be receptive to the recommendation by the Plan Commission subject to the preparation and presentative of an OPD acceptable to the Plan Commission, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego does hereby declare its intent to initiate a petition to rezone certain lands along McShane Road presently zoned Rs3 and 1-2 in Sections 11 and 12 to RS2 and 31.9 acres on the north side of McShane Road, owned by Harold DeBack and Jean Wallner, from 1-2 to RSA. BE IT FURTHER RESOLVED that the Common Council will be receptive to providing an OPD District on those lands owned by Harold DeBack and Jean Wallner when a plan acceptable to the Plan Commission and Common Council has been submitted. e DATED THIS /L DAY OF el7 pz/&.z .m, , 1972.
