APPROVAL OF SUBDIVISION STAKING SURETY BOND
(Durham Meadows and Hale Park Meadows)
WHEREAS, Chapter 236.15 (1) (a) and (b) , Wisconsin Statutes,
require that iron piping for all proposed subdivisions be
completed prior to plat submittal, and
WHEREAS, Ch. 236.15(h) of the Wisconsin Statutes permits the
municipality to waive said requirement, and
WHEREAS, Mr. Jack L. La Bonte, developer of Durham Meadows and
Hales Park Meadows, has requested that the City of Muskego
exercise its rights under Ch. 236.15(h) to expedite their plans
for the development of the area, and
WHEREAS, they have provided a surety bond in the amount of
$5,000.00 for Hale Park Meadows and $3,000.00 for Durham Meadows,
guaranteeing the City of Muskego that said staking will be done,
and \. -
WHEREAS, the developer has indicated that the installation of
sewer water and roads can be more properly installed prior to
the staking of the lots,
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego, under the authority granted them by Ch.236.15 (h),
Wisconsin Statutes, does hereby waive the iron piping requirement
for a period of up to twelve months.
BE IT FURTHER RESOLVED that the surety bond in the amount of
$5,000.00 for Hale Park Meadows and $3,000.00 for Durham Meadows
from the Fidelty and Deposit Company of Maryland to guarantee
the final staking.
BE IT FURTHER RESOLVED that the Clerk and Mayor are authorized
to execute the necessary documents after approval by the City
Attorney.
