CCR1969115RESOLUTION # 115 RESOLUTION LEVYING SPECIAL ASSESSMENT ON PROPERTY IN ASSESSMENT DISTRICT #3 (Dobrowski) @ WHEREAS, a request has been made by the to allow him to connect to the sanitary sewer ma real estate described: owner thereof in fronting the Lot 6, Block 6 in MUSKEG0 SHORES, part of the Southwest Quarter and Southeast Quarter, Section 4, Town 5 North, Range 20 East, City of Muskego, Waukesha County, Wisconsin. WHEREAS, a Waiver of Notice of Special Assessment and Hearings and the levying thereof has been filed with the City Clerk by the owner; NOW, THEREFORE, BE IT RESOLVED: (1) For the purpose of paying a portion of the cost of the construction and installation of a sanitary mer collec- tion system within the City, there is hereby levied and assessed against the above described real estate the sum of $471.00, being the assessment for the installation of an eight-inch sanitary sewer main havinq an 2verage depth of ten feet. Subsequent installments shall include one year's interest upon the unpaid balance of the assessment. a (4) The City Clerk is directed to give notice of this assessment by mailing a copy of this resolution to the owner of the property at his last known post office address or by personal service upon the owner. (5) If the owner of the property shal I f i le with the City Clerk within thirty days from the mailing or service of the aforesaid notice, a written notice that they elect to pay I, 1969, special assessments payable in installments shall not be made against said property of such owners, and the owners shall pay the entire assessment when due. 0 the special assessment upon their property on or before November (6) In the event a person so elects to pay such assess- ment on or before November I, 1969, but fails to do so, the entire amount of such assessment together with interest thereon from date hereof to December 31, 1969, at the rate of six (6%) per cent per annum, which shall be entered on the tax roll for the year 1969 and collected as are other taxes of the City, on a ten year installment basis. e (7) After the time for making such election shall e have expired, such assessment shall be due and payable in in- stallments as aforesaid, but any assessment may be paid in full before due only upon the payment of interest to date of pre- payment upon such assessment plus one year's interest on the then unpaid principal amount of such assessment. e Passed this 23 day of m]&m J , 1969. Mayor PUBLIC WORKS COMMITTEE ATTEST: Ap k, City Clerk WAIVER OF SPECIAL ASSESSMENT NOTICE AND HEARINGS (Assessment Dist. #3) e I, the undersigned, owner of property benefited by the following proposed public improvement to be made by the City of Muskego, Waukesha County, Wisconsin, to-wit: The installation of an eight-inch sanitary sewer main, in considera- tion of the construction of said improvement by the City of Muskego, Wisconsin, hereby admit that such public improvement would benefit my property and consent to the levying of a special assessment against said property under Section 60.60 of the Wisconsin Statutes for the cost of such improvement. In accordance with Section 66.60(18) of the Wisconsin Statutes, I hereby waive all special assessment notices and hearing required by Section 66.60 Wisconsin Statutes and further agree and admit that the benefit to my property from the con- struction of such improvement equals the cost thereof, including the cost of the main as assessed, installation of a sewer lateral and incidental fees, such as attorney, engineering and publication fees . Description of Premises: Lot 6, Block 6 in MUSKEG0 SHORES, part of the Southwest Quarter and Southeast Quarter, Section 4, Town 5 North, Range 20 East, City of Muskego, Waukesha County, Wisconsin.
