CCR1969107RESOLUTION #107-69 (As Amended) RESOLUTION AUTHORIZING THE ACCEPTANCE OF AN ASSIGNMENT OF THE PRESENT MUSKEG0 POST OFFICE LEASE UPON OCCUPANCY OF A NEW POST OFFICE WHEREAS, the United States is presently leasing property in the City of Muskego for the purpose of operating a United States Post Office; and WHEREAS, said lease is now in effect for a term to expire on the 30th day of September, 1973; and WHEREAS, said lease provides as follows: "The Government may sublet all or any part of the premises or assign this lease but shall not be relieved from any obligation under this lease by reason of any such subletting or assignment;" and WHEREAS, the United States may build or authorize the build- ing of a new post office facility in the City at a location in the Civic Center Site; and if this is done, will require the City to assume the present lease. NOW, THEREFORE, BE IT RESOLVED that it is for the benefit and in the interests of the general welfare of the City of Muskego that a new post office building be occupied in the Civic Center Site; that the Common Council is fully advised as to the terms of that certain lease entered into by and between Ray A. Eckstein and Kathryn Eckstein, his wife, and Joe Siemann and Vera Siemann, his wife, Lessors, and the United States of America, Lessee, which lease is recorded in Volume 798 of Deeds on page 352 as Document #493825, Waukesha County records. BE IT FURTHER RESOLVED that upon the occupancy of a new postal facility in the Civic Center Site that the City will accept an assignment of the lease herein referred to for the duration of the present term of said lease; said assignment and assumption to be effective as of the date the United States occupies the new facility; that the Mayor and City Clerk should execute an acceptance of said assignment in the following form: "In consideration of this assignment and transfer by the United States of America, the City of Muskego accepts and assumes all the terms and agreements in said lease contained, and will comply with them, and be bound by them, and will keep and perform all the agreements in said lease contained." BE IT FURTHER RESOLVED that the City understands that the United States relies upon the City's assumption of said lease and that this lease shall therefore be irrevocable.
