RESOLUTION VACATING SPECIAL ASSESSMENT
ON GERALD BEER PROPERTY
(As Amended)
The Common Council having levied a special assessment
on the property in the M1-5 Assessment District, and owned by one
Gerald J. Beer, and indicated on the Assessment Roll as Assessment
#669-D;
And it having been brought to the attention of the
Common Council that said lot does not front on the street, but
is in the rear of the property having the post office address of
W181 S7738 Valley Drive, and that access to the rear lot is gained
over a 15’ x 100 foot easement from the street; and
Whereas, the owner of said lot is unable to obtain the
permission of the owner of the front lot to install a sewer
lateral in said easement to make connection to the sewer main,
and it having been brought to the attention of the Common Council
that a Committee of the Council, prior to the levying of the assess-
ment, had advised the owner that the assessment would not be made.
BE IT RESOLVED, that the special assessment levied
against the property of Gerald J. Beer in the M1-5 Assessment
District, under Assessment #669-D, be vacated for the reason that
said property has no frontage on Valley Drive, and no use of the
improvement can presently be made because the present owner is
unable to install a sewer lateral in the easement leading to said
property.
L BE IT FURTHER RESOLVED, that if in the future use of
the improvement is made or can be made, that the Common Council
shall then reconsider the matter of the assessment of the improve-
ment against the property.
