CCR1969036RESOLUTION #36-69 APPROVAL OF AGREEMENT BETWEEN CASED KENDZIORSKI, JR. AND THE CITY OF MUSKEG0 (Big Muskego Lake) a WHEREAS Phase I of the project known as the Big Muskego Lake Project has been completed, and WHEREAS Phase I1 comprised of sounding of the lake and preparing formal application are necessary if Federal or State funds are to be received to aid this project, and WHEREAS it is possible that it may qualify as a demonstration project, and WHEREAS State and Federal agencies have indicated a keen interest in this type project but desire additional information, particularly soundings of the la.ke, and WHEREAS it has been determined that the cost of completing the second a grant from OPERATION COMEBACK to aid the completion of studies and therefore request that the Common Council authorize this expenditure, THEREFORE BE IT RESOLVED tha,t the Common Council of the City of Muskego does hereby authorize the Finance Committee to enter into the attached agreement (approved by the City Attorney) between the City of Muskego and Mr. Casey Kendziorski. BE IT FURTHER RESOLVED that the cost of such agreement shall not exceed $4,000.00 and shall be subject to review by the Finance Committee who shall report their findings to the Council. BE IT FURTHER RESOLVED that the Mayor and the City Clerk are authorized to execute the necessary documents in the name of the City. BE IT FURTHER RESOLVED that not more than $2,000.00 shall be transferred ’a phase would not exceed $4,000.00, $2,000.00 of which has been given as from Acct. #292 Unappropriated Surplus to Acct. 8602.049, City Planning. PASSED AND ADOPTED THIS 3 3’ DAY OF %! ,1969 Mayor ATTEST: City Clt?rk u- AGREEMENT THIS AGREEMENT, made this 25 day of , 1969, by and between CASEY KENDZIORSKI, JR. of 3378 S. 68th Stree't, Milwaukee, Wisconsin, hereinafter termed "Contractor" and the CITY OF MUSKEGO of termed "City" . Waukesha County, Wisconsin, a municipal corporation, hereinafter WITNESSETH: That the contractor in consideration of the agreement @ on the part of the city hereinafter contained does agree to perform the "Sounding of Big Muskego Lake and Application for State Permit". The contractor further agrees that the studies shall include the following STEPS: STEP 1. Negotiate with the Resource Development Department to allow deviation from the 20 foot increment normally required, for State approval of lake dredging. Apply for a minimum of 500 foot increments, but attempt to obtain much larger increments. STEP 2. Based on the maximum foot increments permitted by the Resource Development Department; Propose the methods and procedures to perform the sound- ings by the Lake Committee and voluntary residents. Specify the Equipment required to perform the soundings. Specify the time required to perform the soundings. Estimate the manpower required to perform the soundings. STEP 3. Design and supply data sheets for the taking and record- ing of the sounding data. STEP 4. Assist the Lake Committee in planning and preparing for the sounding of the lake. STEP 5. Supervise the taking of the soundings, to be performed by the Lake Committee and the volunteer residents. STEP 6. Draw and supply all maps as are required to take the soundings and record and submit to the State. STEP 7. Prepare and submit the necessary forms and applications required for the Department of Resource Development. STEP 8. Prepare and submit the completed forms to the proper authorities and apply for approval. STEP 9. Expedite the approval of the application by the Conser- vation Department and the Department of Resource Develop- ment. STEP 10. Appear at a.nd testify at all hearings, which will be required for State approval. STEP 11. Recommend the next steps to implement the project. Upon completion of STEPS 1 thru 4 above, the contractor agrees to submit a progress report for review to the Finance Committee of the Page 2. Upon completion of STEPS 5 thru 8 above, the contractor agrees to submit a progress report for review to the Finance Committee of the City. Upon completion of STEPS 9 thru 11 above, the contractor agrees to submit a final report and explain the project to the Lake Committee and Council of the City. 0 The contractor further agrees to complete the study within six (6) months. The city in consideration of the agreement on the part of the contractor does agree to pay: Five Hundred Dollars ($500.00) initially at the start. One Thousend Dollars ($1,000.00) upon the completion of STEPS 1 thru 4 and upon receipt of said progress report. Two Thousand Dollars ($2,000.00) upon the completion of STEPS 5 thru 8 and upon receipt of said progress report. Five Hundred Dollars ($500.00) upon the completion of the study, and upon the receipt of the final report, and presentation to the Common Council.
