AS AMENDED
RESOLUTION REGARDING HOLDAW BOND
AGREEMENT WITH BOLDT BUTTER & EGG, INC.
WHEREAS, Boldt Butter & Egg, Inc. a Wisconsin Corporation, authorized
to do business in the State of Wisconsin is currently operating a business
ein the City of Muskego for the purpose of the operation of an egg process-
ing plant, and
(IrlEREAS, the approval of the State Board of Hea.lth must be obtained prior
to the installation of a holding tank to be used in connection with said
egg processing plant, and
WHEREAS, the State Board of Health now requires the deposit of One
Thousand ($1,000.00) Dollars with the city to guarantee compliance with
the rules and regulations of the State Board of Health, and
WHEREAS, the State Board of Health requires the City of Muskego to
service said tank if the owner thereof does not,
NOW, THEREFORE, BOLDT BUTTER & EGG, INC., is firmly held and bound unto
the City of Muskego, Wisconsin, the amount of One Thousand ($1,000.00)
Dollars cash upon the following terms and conditions:
1. Owner will construct and install a 10,000 gallon holding tank
of Health.
2. Owner shall have the tank pumped by a licensed septic tank
pumper with sludge and other material removed from the holding
tank and hauled to an approved place of disposal in a,ccord with
the Wisconsin Statutes, Chapter 146, Chapter RD 13 and Section H 62.20
of the Wisconsin Administrative Code.

3. In the event it becomes necessary for the city to service
said tank or to perform any other obligation imposed upon the
owner with respect to the operation and maintenance of said
tank, then the expense thereof shall be paid for by the city out
of the cash bond on deposit. The City shall submit a statement
of its expenses to the owner. The owner upon receipt of said
statement shall then furnish additional bond cash in a sum
sufficient to maintain the amount on deposit with the city in
the minimum sum of One Thousand ($1,000.00) Dollars at all times.
4. When the use of said holding tank is terminated by the
owners, its successors or a~ssigns by reason of an approved
substituted method of sewage disposal, this bond shall be can-
celled, and the amount of cash held by the city pursuant hereto
shall be returned to the owner.
