RESOLUTION INITIATING PROCEEDINGS TO TAKE OVER
FARM DRAINAGE DIST. NO. 6 IN THE
CITY OF MUSKEGO
WHEREAS the Lepislators of the State of Wisconsin have adopted
Chapter 128 of the Laws of 1965 which creates Sec. 88.83 relating
to thc transfer of farm drains to the city or village's jurisdiction,
and
WHEREAS the City of Milwaukee has petitioned the County Court in
Milwaukee to transfer said drainage district to the City of Muskego,
and
WHEREAS the said farm drains No. 6 no longer serve the farms
originally intended and generally serves an urban area, and
WHEREAS it is necessary that all municipalities involved in the
farm drains in Milwaukee County and Waukesha County adopt a
resolution agreeing to abolish the farm drains, and
0 WHEREAS the Public Works Committee has recommended that such
action be taken,
THEREFORE BE IT RESOLVED that the Common Council of the City of
Muskego does hereby authorize the City Attorneys office to
petition the court having jurisdiction over such drains have an
order transferring jurisdiction to the City of Muskego and recover
from the Milwaukee County Treasurer the amount of funds on deposit
with him relative to said farm drains No. 6.
