COMMON COUNCIL - CITY OF MUSKEGO
RESOLUTION #160-2011
REQUEST EXEMPTION FROM THE DNR FOR ANY LOW FLOW REQUIREMENT
FROM DAM OUTLET
WHEREAS, Wisconsin State Statute 31.34 requires that a dam that is maintained on
any navigable stream shall pass at all times at least 25% of the natural low flow of
water; and
WHEREAS, The Big Muskego Lake dam must remain closed at times to maintain lake
levels within the parameters of the existing dam order; and
WHEREAS, Water remains in the downstream channel even when the dam is closed
and the fish habitat is not adversely affected; and
WHEREAS, The dam has historically been operated such that it remains closed for
periods of time; and
WHEREAS, The Wisconsin Department of Natural Resources will consider an
exemption to the statutory requirement if a low flow is not necessary to maintain fish
habitat and a written request from the owner of the dam is submitted.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego does hereby authorize Mayor Chiaverotti to request an exemption to the
statutory low flow requirement to the DNR on behalf of the City.
