CCR2011075-Borst Extension COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #075-2011 RESOLUTION TO EXTEND THE TIMELINE FOR A SECOND APPRAISAL FOR THE BORST PROPERTY WHEREAS, The Common Council adopted a Resolution of Necessity for the purchase of lands owned by Nancy Borst on January 25, 2011; and WHEREAS, The City has caused an appraisal for the property and sent this information to Nancy Borst on April 20, 2011; and WHEREAS, Eminent domain law of the Wisconsin State Statutes entitles a landowner to obtain a second appraisal at a reasonable cost, which will be paid for by the City of Muskego if such appraisal is provided to the City within 60 days; and WHEREAS, Nancy Borst and her legal counsel have informed the City that an appraiser has been chosen to provide the second appraisal by June 30, 2011; and WHEREAS, Receipt of the second appraisal by June 30 requires an extension of the 60- day deadline; and WHEREAS, The Resolution of Necessity included a Memorandum of Understanding indicating that both parties would negotiate in good faith. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego does hereby extend the timeline from 60 days to 75 days to accommodate receipt of the second appraisal.
