RESOLUTION #039-2011
RETRACTION OF RESOLUTION OF NECESSITY
(Fountainwood Flood Abatement Project)
WHEREAS, The City of Muskego Common Council approved resolution #14-2011 on

February 8, 2011 entitled Resolution of Necessity (Fountainwood Flood Abatement
Project), and
WHEREAS, The City intended to utilize funding from the Milwaukee Metropolitan
Sewerage District’s (MMSD) private property inflow and infiltration (PPII) reduction
program for all or part of the acquisition of the homes discussed in the resolution of
necessity, and
WHEREAS, The City of Muskego has applied for funding from the MMSD’s PPII
Reduction Program, and

WHEREAS, The MMSD issued a letter April 4, 2011 to the City of Muskego which
states that this project has been determined to be ineligible for funding, and
WHEREAS, The City does not intend to move forward with the acquisition of the homes
without MMSD funding, and
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of Committee of the Whole, does retract
Resolution of Necessity, #14-2011.
