RESOLUTION #135-2008
RESOLUTION ACCEPTING DEDICATION OF PUBLIC IMPROVEMENTS FOR
CANDLEWOOD CREEK ADDITION NO. 1
WHEREAS, Towne Realty, Inc. hereafter called “DEVELOPER” has constructed the
following public improvements: sanitary sewer, water main, storm sewer, curb and
gutter and asphalt pavement in Westfield Way, Cherrywood Court and Cherrywood
Drive at the following development:
Outlot 4 and Outlot 5 of Candlewood Creek, being part of the SW ¼ of the NW ¼ of
Section 11, Township 5 North, Range 20 East, in the City of Muskego, County of
Waukesha, State of Wisconsin
;and
WHEREAS, the DEVELOPER has completed the construction and installation of the
following improvements:
Roadways
4,350 L.F. at $6.45/L.F. of 30-inch concrete curb and gutter.
8,375 S.Y. at $1.60/S.Y. of 4-inch crushed aggregate base course.
6,775 S.Y. at $1.95/S.Y. of 4-inch crushed aggregate base course.
6,775 S.Y. at $5.40/S.Y. of 4-inch asphaltic binder course.
6,775 S.Y. at $2.25/S.Y. of 1-1/2-inch asphaltic surface course.
Sanitary Sewer
1,718.4 L.F. at $50.25/L.F. of 8-inch diameter PVC sanitary sewer pipe.
7 EA. at $2,500.00/EA. of 48-inch diameter concrete sanitary sewer manholes.
929.0 L.F. at $27.50/L.F. of 6-inch diameter PVC sanitary sewer lateral.
Water Main
1,820.8 L.F. at $39.00/L.F. of 8-inch diameter PVC sanitary sewer pipe.
5 EA. at $800.00/EA. of 8-inch diameter butterfly valves with valve boxes.
5 EA at $600.00/EA. of 6-inch diameter butterfly valves on hydrant lead pipe.
5 EA. at $1,500.00/EA. of fire hydrants.

26 EA. at $150.00/EA. of 1-1/4-inch diameter curb valves and valve boxes on service

and appurtenances (collectively called “IMPROVEMENTS”) in accordance with the
provision of Chapter 18 of the Municipal Code of the City of Muskego, hereafter called
the “CITY” and the City Engineer has certified the systems’ acceptability; and
WHEREAS, it is the Developer’s intent to, without charge to the CITY, unconditionally
give, grant, convey and fully dedicate the IMPROVEMENTS to the CITY, free and clear
of all encumbrances, and together with mains, conduits, pipes, plants, machinery,
equipment and appurtenances, which relate directly to the utilization of such utilities;
and
WHEREAS, the DEVELOPER shall guarantee the public improvements to be dedicated
against any defects due to faulty materials or workmanship which appear within a period
of one (1) year from the date of dedication and shall pay for any damages resulting
therefrom to the CITY property and shall indemnify the CITY against any claims, suits,
or liabilities brought against the CITY at any time arising out of the alleged defects or
other failure of this guarantee.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego hereby accepts the dedication of the public improvements.
